June 10, 2025 – The Liberty Values & Strategy Foundation (LVS Foundation) today issued a formal condemnation of the ANC Youth League in KwaZulu-Natal (ANCYL-KZN) for its deliberate disclosure of personal information belonging to Israeli participants in the 2025 Comrades Marathon, an act that facilitated targeted harassment and violated multiple provisions of South African law. This reprehensible conduct, which occurred on June 8, 2025, represents a flagrant breach of privacy rights, anti-discrimination statutes, and international sporting ethics, and demands immediate legal accountability.
The ANCYL-KZN publicly released the names and race numbers of six Israeli athletes—Mikhail Oshurov, Avigdor Book, Ami Elkus, Jonathan Watkins, Gil Gemer, and Nick Katsman—in a statement demanding their exclusion from the ultramarathon. This act of doxxing enabled pro-Palestine activists to track and harass the runners during the 89-kilometer race, subjecting them to anti-Semitic slurs, physical intimidation, and accusations of "war crimes" unrelated to their athletic participation.
Legal and Ethical Violations
1. Breach of Data Protection Laws
The disclosure of athletes’ personal information without consent violates Section 11 of South Africa’s Protection of Personal Information Act (POPIA), which mandates lawful processing of data. By weaponizing registration details for political targeting, the ANCYL-KZN contravened Section 13’s purpose specification requirements and Section 19’s security safeguards. Under Section 107, such violations carry penalties of up to R10 million or 10 years’ imprisonment.
2. Cybercrimes Act Violations
The publication of personal data to incite harassment aligns with Section 16 of the Cybercrimes Act, which prohibits data messages intended to threaten persons or property. The coordinated tracking of athletes via social media platforms further violates Section 17’s provisions against cyber harassment.
3. Anti-Discrimination and Hate Speech
The selective targeting of Israeli athletes—amid participants from 80+ nations, including those with contentious human rights records—constitutes unfair discrimination under Section 9 of the Promotion of Equality and Prevention of Unfair Discrimination Act (PEPUDA). The anti-Semitic rhetoric employed during the harassment, including chants of “Down, down Israel,” meets the threshold for hate speech as defined in South African Human Rights Commission v Masuku (2022).
Dr. Fundji Benedict, LVS Foundation CEO stated: “The LVS Foundation unequivocally condemns the ANCYL-KZN’s actions, which undermine the principles of human dignity, privacy, and non-discrimination enshrined in South Africa’s Constitution. Sporting events must remain apolitical arenas where athletes compete free from persecution. This incident not only violates domestic law but also erodes global trust in South Africa’s commitment to upholding international human rights standards.” She added that "“The deliberate doxxing of these athletes represents a criminal act under POPIA and the Cybercrimes Act. We call on the South African Police Service and the Information Regulator to initiate immediate investigations and prosecute all responsible parties to the fullest extent of the law.”
Broader Implications for International Sports
The Comrades Marathon, established in 1921 to honor wartime camaraderie, has historically transcended political divisions, including its integration of Black runners during apartheid. The 2025 incident marks a dangerous precedent where athletic competitions are weaponized for geopolitical agendas, threatening the safety of participants and the integrity of international sports.
The LVS Foundation emphasizes that such actions contradict the International Olympic Committee’s Principle 6, which mandates political neutrality in sports. Failure to address this harassment risks deterring athletes from contentious regions from participating in future events, thereby fracturing the global sporting community.
