La situation qu’affronte Israël à Gaza actuellement résulte d’une convergence de précédents juridiques, d’obligations morales et de nécessités stratégiques ; autant d’éléments qui justifient une action globale et résolue. Les consultations du Premier ministre Benjamin Netanyahu avec les responsables de la sécurité, portant sur l’intensification des opérations à Gaza, ne relèvent pas de simples considérations tactiques : elles soulèvent des questions essentielles de responsabilité de l’État en droit international, ainsi que l’impératif de protéger les citoyens contre l’affamement intentionnel et la mort imminente. Cette crise dépasse l’analyse militaire ; elle engage également le statut juridique de Gaza, la doctrine de la légitime défense et l’urgence médicale des otages, dont la survie se joue chaque jour.

Les implications du conflit excèdent largement les frontières de Gaza. Les organisations terroristes du monde entier observent pour savoir si la stratégie explicite du Hamas — affamement méthodique et torture des otages — sera tolérée, et si elle pourrait devenir un modèle opérationnel.

Au cœur de la position d’Israël se trouve la reconnaissance que Gaza ne constitue pas un État souverain. L’application de la Quatrième Convention de Genève suppose la présence de forces étrangères sur le territoire d’une « Haute Partie contractante ». Or Gaza ne dispose ni de souveraineté reconnue ni des attributs essentiels de l’État ; elle échappe donc au cadre classique du droit de l’occupation. Tout retard accroît les séquelles irréversibles et conduit à des décès. Face à cette situation, les obligations morales et juridiques d’Israël ne sauraient être subordonnées à un délai diplomatique, le Hamas ayant démontré que les négociations ne sauvent pas de vies.

Les répercussions internationales sont également majeures. Si la torture et l’affamement organisé d’otages demeurent impunis, ils établiront un précédent dangereux pour le terrorisme mondial : Boko Haram, l’État islamique et Al-Shabaab copient déjà les méthodes qui réussissent. L’usage de la privation alimentaire comme arme, associé à la propagande psychologique, pourrait se généraliser. Des groupes affiliés à l’« Axe de la Résistance » iranien et à la Jihad islamique palestinienne ont déjà adapté des tactiques similaires.

Le droit international, par son article 51 de la Charte des Nations unies, consacre le droit inhérent à la légitime défense individuelle ou collective, incluant la protection et le sauvetage de ressortissants à l’étranger. Les trois conditions — nécessité, proportionnalité, immédiateté — sont ici réunies : nécessité face au risque de mort imminente, proportionnalité limitée à la libération des otages et à la prévention de nouvelles attaques, immédiateté imposée par l’échéance médicale. Au-delà du droit, l’affamement volontaire et la torture constituent une cruauté universellement prohibée. Seule une intervention ferme, visant à stopper ces souffrances et à démanteler l’infrastructure terroriste du Hamas, répondra aux impératifs de droit, aux exigences éthiques et aux nécessités tactiques. Un contrôle effectif sur Gaza permettrait aussi une distribution humanitaire plus transparente, empêchant le détournement des vivres par les terroristes.

Ces considérations plaident en faveur d’une prise en main globale de Gaza. Poursuivre les négociations tandis que les otages meurent reviendrait à nier la responsabilité de l’État ; permettre au Hamas de triompher de sa politique de torture et d’affamement constituerait un précédent dangereux, susceptible d’encourager l’institutionnalisation de ces méthodes. Une initiative vigoureuse n’est donc pas seulement justifiée : elle est indispensable.

Honorer la promesse de Yoni : continuité morale

La perspective d’opérations décisives à Gaza s’inscrit dans une continuité historique et morale. Il y a près de cinquante ans, le lieutenant-colonel Yonatan Netanyahu tomba lors de l’opération d’Entebbé, mission audacieuse qui ancra la promesse israélienne de ne jamais abandonner ses citoyens face à la terreur. À l’image de l’« Opération Tonnerre » de 1976, qui prouva que l’État protège ses ressortissants partout, une action pérenne à Gaza empêcherait la répétition de crises similaires. Ne pas agir enverrait un signal mondial : la torture organisée et l’affamement méthodique d’otages sont des tactiques viables. Rompre ce cycle offrirait au contraire un modèle de leadership moral, rappelant qu’aucune complexité ni aucun danger ne justifie l’abandon des innocents.

Le devoir qui incombe à Israël tire sa force de l’héritage de Yoni Netanyahu. L’opération nécessaire pour secourir Evyatar David et Rom Braslavski, et briser la méthodologie de torture du Hamas, concrétise une promesse sacrée. Comme en 1976, Israël doit démontrer au monde entier qu’il ne renoncera jamais à défendre la vie innocente, même si cela exige le sacrifice suprême.
